Rear Brake spring

When I stripped my 1200TS the rear brake pedal did not have a return spring, so I got a new one.I have tried a few ways to fit it but it does not fit,when operating the brake pedal the spring section that is clipped around the pedal lever hits the swing arm, any ideas guys

I would say, come and look at mine fitted to TOG, but you are a tad too far away,
if no one chimes in I will try and take some pictures, bike is going back on ramp, probably Wednesday, which will make that a much more pleasant task.

probably not that much help but here goes
3263 is taken from the underside of the bike
3260 is from above
it is all very tight in there but does clear, could it be that your swing arm is sitting too far to the left? but I have no idea how that could occur, so maybe the triangular tube bracketry is misplaced?
