NSW CTP Insurance.

Following on from my previous post regarding CTP insurance cover for an accident I had in Tasmania last November I can confirm that neither NSW or Tasmania will cover medical expenses incurred.
The incident was brought to the attention of the Motor Cycle Council who brought it up to SIRA and Victor Dominello MP, Minister for Customer Service. His response is as follows;

"CTP insurance is a third-party insurance policy that protects the owner or driver of a motor vehicle from being personally sued for the injuries their vehicle may cause to others. While CTP insurance is mandatory in all Australian States and Territories, each has  different laws and processes, and these determine compensation eligibility and entitlements. Under the Motor Accident Injuries Act 2017 (NSW), a person is only entitled to receive statutory benefits if they sustain an injury or died as a result of a motor accident in NSW."

The wording on the SIRA site has now been amended.

"Any person travelling INTERSTATE may wish to consider taking out other forms of insurance to cover health costs associated with personal injuries, such as private health or travel insurance"

Please take note that NSW CTP only covers NSW and NOT other States.
 
Does that mean we now need travel insurance to cross a state border, that is when they open state borders after the virus? Has anyone told the Federal Government about this impediment to free travel in our free land? This is very strange and I bet uncommon knowledge.
 
Absolute bullshit. Time to go to our local Fed MPs and make serious complaints. CTP is being run as if it was an optional form of insurance taken out with a private company. What the fukk is going on??? State jurisdictions? What??? It HAS to be overseen by the feds.

Unfortunately yes, the way the law stands we do need to take on additional medical and travel cover for interstate travel.
Each State have there own agreements with each other, it's just that NSW sucks.

From my reading of the Vic system, we would have been covered had we been the unfortunate Woody in Tassie.

Under the Victorian CTP scheme, compensation is payable for injuries or death, where the transport accident occurs:

..... in Victoria (even if the vehicle is registered interstate) or
..... interstate and the vehicle is registered in Victoria and the person injured is a Victorian resident or was in the Victoria-registered vehicle.

The scheme is not fault based. The TAC does not consider fault when determining eligibility for compensation under the scheme.

If i'm right, NSW residents need to make a huge rumpus over this.
 
Blimey, that's nuts. The Tasmanian CTP covers me anywhere in Australia if I'm driving a Tasmanian registered vehicle. At least that's what it says on the website.

I guess you fall between the cracks because nobody else was involved, so it's presumed to be your fault. CTP doesn't cover "at fault" drivers.

I'd suggest your best course of action is to forget seek reparation under common law. People injured are entitled to pursue damages under common law where the fault of another party can be established. It can be easily established that you were not at fault (witness statements, etc.) so it would seem to follow that someone else was. In this case, you need to show that the Tasmanian Government was negligent in the removal of rotten dead trees alongside the road.  Only problem is that you'll have to dig into your pocket to pay for legal representation. I reckon you need to have a chat with a personal injury lawyer.

Chrisk's idea to talk to the media isn't a bad one. It's a ridiculous situation that your NSW CTP insurance doesn't have the same cover as other states. Especially when the Green Slip website says this "Even though your motor vehicle is registered in NSW, your insurance provides you with cover regardless of where you are in Australia." https://www.greenslips.com.au/faqs.html
(It has the caveat that the "driver at fault" is not covered, but it can be pretty convincingly demonstrated that you were not at fault.)

My take on Glad, I find it refreshing that for a change we don't have a polished up turd high on the political tree. These usually attractive pigdogs smile there way to the top, where Glad is a relly solid administrator and very hard worker even being on the opposite to my usual voting ways. She must have some qualities rising to the top in that Bear Pit.
 
I agree Vince, usually the libs just make me want to vomit but in this crisis all have been pretty bloody good, even Sooty once he realised he couldn't go to the footy has been up to the task.
Im sure Gladys has had plenty of sledging regarding her nose, we aren't all born like movie stars, its how they behave that counts.

Perhaps a poor choice of words. Grimshaw is no worse than some of the dickhead journalists on TV, like John Laws or Kyle Sandilands, and the Current Affair program is probably the most likely to run with a personal hard luck story to a wide audience. Although in recent years I think she's been dumbed down a lot, probably by the show's producers. Maybe she was better in the old days. I haven't watched A Current Affair for about 10 years.
 
One in a blue moon she does some actual Journalism but the show is usually just slock. I just wish I had taped the show where she meets Wayne Gardineer and decided to take up Motorcycling, so off to Eastern Creek they go for a track day and she hits 140kph on her bike and then gets pillioned on Wayne Fireblade. The video is long gone but the sound of her screaming her lungs out at 200ks plus will long live in my memory. Some comments from the time.
